A federal judge has scheduled an October 2016 trial for the wrongful death lawsuit brought against the city of Ferguson by Michael Brown Jr.’s parents after a White police officer fatally shot their 18-year-old son in August 2014.

The decision, announced by U.S. District Judge E. Richard Webber in St. Louis, means the family won’t see a courtroom for another year. According to the Associated Press, Webber previously dismissed four of the seven counts against the city and other defendants (including ex-police officer Darren Wilson and former Ferguson Police Chief Thomas Jackson), saying Brown’s parents — Lesley McSpadden and Michael Brown Sr. — needed a “more persuasive claim” to prove damages.

The city of Ferguson has asked that the suit be thrown out completely.

Activists and residents of the St. Louis area recently observed the one-year anniversary of Brown’s death, with demonstrations calling for an end to state violence and vigils remembering the Ferguson teenager. Just days after the anniversary, St. Louis police shot and killed another Black 18-year-old identified as Mansur Ball-Bey. Police say the teenager pointed a gun at them as he fled a home they were planning to search.
